Professional Experience

Jodi M. Newberry's practice focuses on primarily complex business and commercial litigation.

Ms. Newberry's litigation experience covers a broad range of issues, including breach of contract, antitrust, landlord-tenant, breach of fiduciary duty, legal malpractice, insurance coverage and other business torts. Ms. Newberry also has extensive knowledge and experience involving insurance coverage and bad faith litigation.

Ms. Newberry has advised and represented clients in all aspects of litigation, including taking and defending percipient and expert depositions, drafting dispositive motions, arguing motions to the Court, representing clients at mediation, and participating in jury focus groups.

Current matters include:

  • Assisted David Rosen in obtaining a defense verdict in a securities class action against the directors and preferred shareholders of a publicly traded company in which plaintiffs alleged that defendants breached their fiduciary duties by selling the company's assets and distributing the proceeds to the preferred shareholders, leaving nothing for the common. After a four week bench trial, the Court ruled that defendants did not breach their duties and that the transaction was fair to the common shareholders.
  • Representing a web-based advertisement placement company as a plaintiff in several breach of contract actions.
  • Representing a medical group partnership in several lawsuits filed by former partners seeking continuing compensation after their resignation from the group.

Recent matters include:

  • Successfully defeated three separate lawsuits filed against different clients in California on motions to dismiss based on lack of personal jurisdiction.
  • Represented an individual sued for sexual harassment. After vigorously defending the action and obtaining several favorable court Orders, the case settled favorably for the client.
  • Represented Lloyds of London as a plaintiff in a legal malpractice action arising out of faulty coverage advice; the case was successfully resolved through mediation.
  • Represented a Fortune 500 corporation in an insurance coverage dispute involving underlying personal injury litigation.

Other Professional Activities

Ms. Newberry serves as a mediator for Los Angeles Superior Court and is a member of the Association of Business Trial Lawyers. Ms. Newberry's mediation experience focuses on breach of contract, insurance coverage, and landlord-tenant disputes.

Prior Professional Experience

Prior to joining Murphy Rosen, Ms. Newberry was Senior Counsel at O'Neill, Lysaght & Sun where she handled complex commercial and insurance coverage litigation. Prior to that, she worked as Senior Counsel to Hancock, Rothert & Bunshoft in Los Angeles, and as a litigation associate both at Ropers, Majeski, Kohn & Bentley in Redwood City and at Gibson, Dunn & Crutcher, in their Los Angeles and New York City offices.
